Terms of Use
These Terms of Use (“Terms”) govern your access to and use of erClick (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
We reserve the right to remove content and take enforcement action as described below. Users are solely responsible for content they upload, post, or share.
1) Eligibility (13+)
You must be at least 13 years old to use erClick. If you are under 18, you must have permission from a parent or legal guardian.
2) Your account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account.
- You agree to provide accurate information and keep it up to date.
- You must not impersonate others or misrepresent your affiliation.
3) User-generated content (UGC)
3.1 Ownership
You retain ownership of the content you submit to the Service (“User Content”).
3.2 License you grant to erClick
To operate the Service, you grant erClick a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, distribute, publicly display, perform, and create technical modifications of your User Content in connection with operating, improving, and promoting the Service (for example, formatting and transcoding). This license ends when your User Content is deleted from the Service, except to the extent content has been shared with others who have not deleted it or to the extent we must retain copies for legal, safety, or backup purposes for a limited period.
3.3 Your responsibility for User Content
- You are solely responsible for your User Content and any harm resulting from it.
- You represent and warrant that you have all rights, licenses, and permissions needed to upload and share your User Content.
- Music/audio rule: if you upload or attach music/audio, you must own the rights or have an appropriate license/permission. Uploading copyrighted songs, instrumentals, or samples without rights is prohibited.
4) Prohibited content and conduct
You must not post, upload, share, or facilitate content or behavior that:
- Violates any law or regulation.
- Infringes intellectual property rights (copyright, trademark), including unauthorized music/audio uploads.
- Contains pornography, nudity where prohibited, sexual exploitation, or content involving minors.
- Promotes violence, threats, incitement, hate speech, harassment, or bullying.
- Includes scams, fraud, deceptive practices, spam, or malicious content.
- Attempts to gain unauthorized access, disrupt the Service, or use bots/automation to misuse the Service.

5) Moderation and enforcement
We may (but are not obligated to) review, monitor, and remove User Content at any time. We may take enforcement actions including:
- Removing or restricting content
- Issuing warnings
- Temporarily suspending accounts
- Permanently banning accounts
- Reporting to law enforcement where appropriate
6) Copyright / notice-and-takedown
We respect intellectual property rights and expect users to do the same. If you believe content on erClick infringes your copyright, you may submit a notice to support@erclick.org with:
- Your name and contact information
- A description of the copyrighted work you claim is infringed
- The location of the allegedly infringing content (link, username, and any relevant identifiers)
- A statement that you have a good-faith belief the use is not authorized
- A statement that the information is accurate and you are the rights owner or authorized to act on their behalf
We may remove or disable access to the reported content and may terminate repeat infringers.
7) Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time for any reason, including for violations of these Terms or our policies, suspected fraud/abuse, or to comply with law.
8) Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and merchantability.
9) Limitation of liability
To the maximum extent permitted by law, erClick and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your content or transmissions.
10) Virtual currency (if applicable)
The Service may include virtual currency or points (for example, “ER”) for in-app use. Virtual currency has no real-world monetary value and is not redeemable for cash, except where required by law or explicitly stated in-app.
11) Governing law and jurisdiction (India)
These Terms are governed by the laws of India. Subject to applicable law, courts located in India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
